The Fresh Beat Band -- Kiki (Yvette Gonzalez-Nacer), Marina (Tara Perry), Twist (Jon Beavers), and Shout (Thomas Hobson) -- kick off the second leg of their hugely popular nationwide concert tour today in Florida and will travel to 62 cities across the country, performing in 75 shows. Former "Dora The Explorer" Voice Artist Caitlin Sanchez Attempting To Restart Her Legal Battle With Nickelodeon

Ex-'Dora the Explorer' Trying to Restart Legal Battle With Nickelodeon

Caitlin Sanchez desperately attempts to escape a $500,000 settlement of her previous lawsuit by arguing that her former lawyer committed "fraud."

Remember Caitlin Sanchez?

In 2010, the teenager who voiced Dora the Explorer made a huge news splash by filing a $10 million lawsuit after she was fired upon reaching puberty. The attorney for Sanchez threatened to expose humiliating secrets about Nickelodeon if the network didn't make his then-14-year-old client a substantial offer to settle her lawsuit over an "unconscionable" contract.

Then, the suit settled on confidential terms and Sanchez faded into obscurity save a few articles that marveled how grown up she now looked.

But the dispute really never went away. In fact, THR has learned that it's gotten really ugly, with Sanchez' family accusing her former lawyer of forcing a bad settlement down their throats. The family who once sued for $10 million now says they were "duped" into a deal that left Caitlin on the hook for substantial tax payments and lawyer contingency fees, pretty much wiping out the money she received. Almost since the moment the settlement was signed, Sanchez has been attempting to unwind it and reinvigorate her lawsuit against Nickelodeon and MTV Networks.

Sanchez' original claims were juicy fodder for tabloids.

In October 2010, she claimed that when she had made a deal to voice Dora the Explorer, she was given just 22 minutes to sign the contract without an experienced lawyer or lose the gig. She alleged that she was promised substantial compensation from merchandising and residuals, but that she was underpaid for her work on a franchise that is said to have earned over $11 billion in global retail sales since 2001.

A New York attorney named John Balestriere represented her. He went to the press and gave the network a deadline to pay up or said he would blab scandalous information. At the time, Nick reps openly complained about his use of "intimidation tactics."

A settlement came before the dispute went far in court. According to recent court papers, Sanchez got $500,000 to cover what she claimed she was due plus as an advance on future residuals and merchandising. She also got five percent royalties on future merchandise sales, some guarantees that she would continue certain voiceover work at the AFTRA rate, and the right to conduct audits on the producer's financial books.

A good deal?

Not according to Sanchez' family members, who have since given sworn declarations to the court how during the early days of the lawsuit, Balestriere was sanctioned for publicizing confidential information about Viacom and soon thereafter, as Balestriere made a brave public face to the press, he privately pushed the family towards settlement.

Sanchez' parents say that they didn't want to take a deal but that Balestriere yelled at them, threatening that he would lose the case and that they would owe him some $300,000. The family says Balestriere told them that dismissing "with prejudice" wouldn't mean they gave up the right to sue Nickelodeon (which the family later discovered was false) and Sanchez' father says that Balestriere falsely notarized his signature on settlement papers.

Further, they allege that the attorney they hired to handle a lawsuit over an "unconscionable" Dora the Explorer voiceover deal himself made the family sign a retainer agreement whereby Balestriere would get 37.5 percent of royalties -- including future royalties -- "as if he was her talent agent," plus a $755 an hour billable rate and things like a "success fee."

In January 2011, the family fired Balestriere, but they say that he continued to interfere with Sanchez' business.

As a result of the case, the Sanchez family owed Balestriere more than $200,000 for his work (on top of whatever payments they already had made). They were also on the hook for $106,000 in taxes because, according to the teenager's mother, Balestriere failed to have the settlement payments attributed as royalties. "That (tax) liability zeroes out what little settlement Mr. Balestriere gave to Caitlin after he took his excessive fees and disbursements never approved by this Court," her mother said in a declaration in June, 2011.

Reached for comment, Balestriere defends himself.

"My colleagues and I were glad to fight for Caitlin Sanchez and her family when they were not given their due by Nickelodeon," he says. "We obtained an excellent result for Ms. Sanchez, in fairly short order, where our firm largely bore the financial risk, and where the court who approved the settlement has repeatedly praised the result our work obtained."

The family doesn't agree and has been furiously fighting to vacate the settlement and get out of paying Balestriere. So far, those efforts have been unsuccessful.

Last November, New York judge Thomas Griesa declined to overturn the settlement, saying the family should first send an auditor to Nick parent Viacom to carry out an audit, and then if there are any discrepancies, it can be handled appropriately.
The family soon tried a new argument that a federal court lacked subject matter jurisdiction. Viacom opposed. A judge rejected a second motion to vacate the settlement in April, reiterating what he said the previous autumn.

In June, Judge Griesa reviewed the money owed to Balestriere, who intervened in the case to defend himself. The judge confirmed that Balestriere was due about $193,000. "Although Sanchez now questions the wisdom of the settlement, it cannot be denied that she quickly obtained a substantial sum of money and valuable audit rights, and the court has repeatedly approved the reasonableness of the settlement," wrote the judge.

However, Judge Griesa ruled that allowing Balestriere's requested 30 percent of Sanchez' future recoveries of royalties to be "excessive" and trimmed it down to 15 percent.

All these decisions are now under appeal at the 2nd Circuit as the former child star of Dora the Explorer looks to redo her lawsuit against Nickelodeon and MTV Networks with new lawyers.

Broken Sword Video Game Franchise Set To Return, With The Help Of Nickelodeon Artists

Charles Cecil takes to Kickstarter to fund new Broken Sword

The Broken Sword franchise is set to return – provided it wins sufficient support on Kickstarter.

Original series creator Charles Cecil has taken to the crowd funding platform and hopes to emulate the success of Tim Schafer’s successfully funded new Double Fine project.

Broken Sword: The Serpent's Curse Adventure will, if it is green lit, be the fifth game in the series and the first since 2006.

Hero George Stobbart will return, as will his original voice actor Rolf Saxon. The game’s 2D artists are said to have experience with companies such as Disney, Dreamworks, Nickelodeon and Aardman.

Cecil’s funding goal in $400,000, of which $12,232 has already been raised (at the time of going to press).

A $15 pledge will earn a digital copy of the game and a $25 the game plus assorted digital extras. $100 earns a Limited Edition physical copy. $500 gets a signed version.

For $1,000 you’ll get a personal signed message from Cecil. Add another $4,000 onto that and you’ll receive a personal voice message from characters George and Nico as well as a drawing of yourself with the characters.

“Revolution adventures have had considerable success – but the traditional publishing model has prevented us receiving the required royalties to fund future games,” the official pitch reads.

“With limited financial reserves we have been unable to fund our own titles and so we have not benefited from their success. Now you can help us to change this. Revolution begins Broken Sword 5 Kickstarter

Put point and click developers Revolution Software down as the latest group of folks to jump on the Kickstarter bandwagon, as the British based codeshop aims to get a fifth entry in their Broken Sword series off the ground with help from the popular crowd-funding initiative.

Broken Sword 5, or, Broken Sword : The Serpent’s Curse as it is to be known, will bring back together series stalwarts George Stobbart and Nico Collard in a completely new point and click 2D adventure which aims to stay true to the roots of the series. Graphically, the game is as nut-wrenchingly gorgeous you would come to expect from Revolution Software; employing a mixture of deliciously detailed 2D handpainted backdrops, 3D backgrounds and 3D models all displayed in good old fashioned two dimensions.

The UK based codehouse is looking to bring the game to PC, MAC, iOS and Android formats with a console release only possible if a suitable deal can be reached with the console manufacturers once their Kickstarter funding target has been reached.

In terms of that target, Revolution Software are looking for $400,000, with their total at current writing with twenty-nine days to go standing at $8,380.

The total is not required to fund development of the title (the game is already six months into its production schedule), but instead it is needed to apply extra polish to the title (never a bad thing) and will also enable the developer to release the game without a publisher looming over their shoulder (definitely not a bad thing).

We always tell children it's rude to play with your food. But when circus performers hang upsidedown while you're eating, chefs juggle knives by your table and waiters only stop bringing you food when you show them a red card, it's hard not to join in the fun.

Dining has always been an important part of any cruise holiday but on Norwegian Epic, food as theatre has been taken to whole new heights.

During Cirque Dream And Dinner, the incredible acrobats performed mind-boggling feats above us and we had to remind ourselves to eat the three courses that had been served in the Spiegeltent big-top restaurant.

With 20 eating establishments on board Norwegian Epic, our four-night mini cruise around the Mediterranean gave me only enough time to get a taste of the options available.

Launched in 2010, the 4,100 passenger Epic dwarfs most other big cruise ships, but despite its hulking size, the ship has a pleasant flow and well-thought-out design inside. Studio single cabins are a genius idea; these cool inside-facing pods, with mood lights and a communal lounge area, are perfect for solo passengers who don't want to pay a single supplement.

Elsewhere, balcony cabins have a 'wavy' design, with an unusual bathroom arrangement, but use their available space excellently. There are also interconnecting staterooms.

Taking the tots along doesn't mean having to sacrifice on style when it comes to staterooms. Some of the most luxurious suites, such as the Haven two-bedroom balcony villas, are perfect for a family of four.

This luxurious ship-within-a-ship area called the Haven is an exclusive place for Haven villa and suite guests. With its own plush lounge, dining room, pool, spa and gym area, there's no need to venture out into the ship.

It would be a shame not to, though, as there is so much going on. Kids big and small can enjoy a ride on one of the three water slides in the Aqua Park. Teens and adults can indulge in treatments in Mandara, the largest spa at sea. There's also the Posh Beach Club – an adults-only area of day beds.

NCL Epic is a fun place for a holiday with friends and couples, but she is also an ideal place for families to enjoy a quick getaway. Norwegian Cruise Line has a partnership with TV channel Nickelodeon and so children can enjoy a Dora's dance party, breakfast with SpongeBob SquarePants or take part in messy 'splash mobs' with Team Nick.

Adult after-dinner entertainment in the 20 bars and lounges is a good mix of comedy in Headliners, DJs in slinky Bliss Ultra Lounge and live music in Fat Cats jazz club – not forgetting the famously offbeat theatre and on-beat percussion of the Blue Man Group in the Epic Theatre, or a drink in -20C temperatures inside the only ice bar at sea.

Nickelodeon UK Picks Up Broadcast Rights For Brand New Dance Themed Drama Show "Dance Academy"

According to World Screen, Nickelodeon UK and Ireland have acquired the broadcast rights to the Australian teen-oriented television drama "Dance Academy", a series which follows the efforts of young dancers training at a prestigious dance school called the National Academy of Dance. Nickelodeon USA's TeenNick Network also picked up the broadcast rights to the series in February 2012.
Dance Academy, produced by Werner Film Productions, was recently sold to Teen Nick in the U.S. and Nickelodeon in the U.K.

Production begins on Dance Academy season three

Production on season three of ABC3′s hit live-action teen drama series Dance Academy has started in Sydney, Australia.

The new season (13 x 24 minutes) of the Werner Film Productions series follows small-town girl Tara Webster (Xenia Goodwin) and her friends as they complete their final year at the fictitious National Academy of Dance in hopes of attaining a professional dancing contract.

Dance Academy has now been sold to more than 180 territories and recently debuted on TeenNick in the US and Nickelodeon in the UK. The series also airs in Germany, France, Italy, Spain and throughout Europe, South America, Africa and Asia.

The new season, which is expected to air from mid-2013, brings the total number of Dance Academy episodes to 65.

According to ABC TV’s controller of children’s television Tim Brooke-Hunt, the series has also experienced success online via social media and on ABC3′s YouTube channel.

Musician wins national praise

GUITARIST James Bell has come top in a TV talent competition.

The 13-year-old, from Audley – last year's winner of The Sentinel's Bright Young Thing Award – was presented with the Rising Music Star award in the Nickelodeon Fruit Shoot Skills competition.

James beat off competition from a DJ, a drummer and a pianist to clinch the award.

His mum Tina said: "James was presented with his skills award by Pixie Lott. We enjoyed watching it on TV."

The awards were set up to celebrate the accomplishment, talent and dedication of young people across the UK. Winners in six categories were voted for by the public after videos were posted on YouTube.

A spokesman for Nickelodeon said: "James really is the people's champion."

As Viewership Falls at Some Networks, Company Increases Air Time for Commercials to Maintain Revenue

Fewer people have been tuning into some of Viacom Inc.'s cable channels over the past year, so the company has turned to a timeworn but controversial method of maintaining ad revenue: adding more commercials.

According to data from TV-research firm Nielsen, the media conglomerate's Nickelodeon and Comedy Central networks boosted the amount of ad time they aired in the first half of 2012 by 9% from a year earlier, to a combined 1,901 hours. That followed a 7% rise in all of 2011 and a 4% rise in 2010, Nielsen found.

As viewership drops at some of Viacom's channels, what the company receives for a typical commercial spot can decrease. Increasing the amount of commercial time allows Viacom to make up some of the impact of the sharp ratings declines.

Viacom's U.S. ad revenue fell 7% in the June quarter from a year earlier, after rising 1% in the March quarter. But that compared with a 29% drop in viewership at Nickelodeon, one of the company's biggest channels, in the first half of the year, according to a report by Barclays Capital, based on Nielsen data. Other Viacom channels, including Comedy Central, have also lost viewers, but by a much smaller degree.

Viacom acknowledges that it has increased the load of ads, describing it as a short-term strategy. "We see this increased commercial load as a temporary situation that we will address as ratings improve," a company spokeswoman said. Viacom Chief Executive Philippe Dauman said earlier this month Nickelodeon was "beginning to show momentum."

Media buyers, however, warn that adding more commercials can alienate both viewers and advertisers. They say that consumers have a certain amount of tolerance for advertisements, but don't like commercial breaks that run on too long. And if the amount of clutter reaches a certain level, commercials won't resonate as well with viewers.

"It is disappointing that Viacom networks continue to shore up their ratings underperformance by adding incremental clutter to an already crowded commercial environment," said Jason Kanefsky, executive vice president of strategic investments at MPG, an ad-buying firm owned by Havas SA. "This strategy seems disconnected with their clients' needs," he said.

Even before the latest increases, Viacom's channels were known to generally have heavier loads of commercials than many rivals, ad buyers say. The precise amount varies by channels. One buyer estimates that the average number of prime-time commercial minutes per hour ranges from 12 minutes and 30 seconds at MTV to 16 minutes and eight seconds at Nick at Nite. Nickelodeon, which aims at children, has a lower ad load, with nine minutes and 26 seconds, the buyer estimated.

Viacom didn't disclose how many commercials it runs during its shows.

In contrast, Walt Disney Co.'s ESPN plays nine minutes and 27 seconds of commercials per hour and Discovery Communications Inc.'s Discovery Channel plays 10 minutes and 59 seconds, the person said. Discovery and ESPN declined to comment.

One media buyer said the increase in the ad clutter has caused his firm to cut back on what it spends on some Viacom networks. "Nick at Nite has been devalued because of underperforming ratings and it's been compounded by them increasing the ad clutter," the ad buyer added.

Viacom isn't the first network to add more commercials when ratings softened. "It's a common tool," says Brian Wieser, a media analyst at Pivotal Research Group. "But you can't keep making up for shortfalls in ratings by adding to your commercial load. It's a nice tool to manage short-term problems."

Another media buyer said that Viacom's move to increase the ad load is a "double-edge sword," since increasing the length of ad breaks usually results in ratings falling as viewers are more inclined to leave a show that is overcluttered with ads.

Thanks to the growing availability of Internet video, viewers may be more likely to switch off their televisions if they grow impatient with commercials. Older seasons of some Viacom programs like Nickelodeon's popular cartoon "SpongeBob SquarePants" can be watched commercial-free on Netflix Inc. Analysts have questioned whether that has contributed to Nickelodeon's ratings declines.

More headlines about "SpongeBob" not soaking up any ratings or "Dora the Explorer" having lost her way are coming. The latest blow came in a Wall Street Journal report that Nick and Comedy Central have boosted their ad loads as ratings have dropped. The master of Kung Fu fighting battled tirelessly against the masters of the surreal, but there could only be one winner - Kung Fu Panda!

Week three saw master secret agent Dudley Puppy take on the Masters of the Multiverse take to the arena in T.U.F.F. Puppy Vs. Matt Hatter Chronicles, but in the end, Nickelodeon's super sleuth proved no match to Nickelodeon's very own dimension explorer, Matt Hatter.

Week four saw the paramilitary penguins fight the master of screams themselves, Uncle Grizzly and his half-brother, The Night Night Porter, in The Penguins Of Madagascar Vs. Grizzly Tales for Gruesome Kids. No amount of gruesome tales read by the Uncle Grizzly and The Night Night Porter could put the The Penguins Of Madagascar off, who went on to claim victory!

Nickelodeon Decides Not To Renew "How to Rock" For A Second Season; Series To Conclude With Festive Christmas Holiday Special Called Called "How To Rock Christmas" In December 2012

Breaking Nickelodeon News - David Israel, who is the Executive Producer on Nickelodeon's live-action comedy show "How to Rock", has announced and confirmed in a blog post on his official Tumblr blog, "On The Emmus", that Nickelodeon has decided to cancel and to not renew "How to Rock" for a second season (season 2), marking Nickelodeon's fourth live-action show cancellation this year, behind the hit Nickelodeon shows "iCarly", "Bucket & Skinner's Epic Adventures" and "Victorious", which were cancelled by Nickelodeon earlier this year.

Although David Israel, who also served as showrunner on Nickelodeon's "How To Rock", expressed his disappointment and acknowledged the disappointment of the Nickelodeon show's many fans at the Nickelodeon News, David Israel took the opportunity to remind "How To Rock" fans and Nickelodeon viewers the good news that there are still nine brand new episodes of "How To Rock" that Nickelodeon USA will be premiering and showing soon, and that the last episode (series finale) will be a 'tremendous, festive, funny and touching' Christmas holiday special called "How To Rock Christmas", where fans will be able to see Kevin Reed (Christopher O'Neal) and Nelson Baxter (Noah Crawford) dressed as elves, which Nickelodeon USA have scheduled to premiere on Saturday 8th December 2012 (transmission (TX) time to be confirmed by Nickelodeon USA).

Fans of Nickelodeon Stars Noah Crawford and Christopher O'Neal will also be able to continue to watch them on their brand new Nickelodeon show "You Gotta See This".

How To Rock The Future

Hey, HTR Fans.

David Israel here. How to Rock’s showrunner and Executive Producer.

There have been rumors swirling around about the future of How To Rock so I thought it time to set the record straight. Nickelodeon has decided, unfortunately, not to give How To Rock a second season. I know this news will be very disappointing for many of you. Believe me, it’s disappointing for me, too.

Why isn’t the show coming back? There’s no one simple answer. NIckelodeon is going through a transition right now. You already know that iCarly and Victorious are not coming back. Nickelodeon has many new shows in production and development that they believe will better suit their audience. While I don’t love their decision, I have no choice other than to accept it. The Nickelodeon executives who’ve worked on the development and production of How to Rock have been incredibly supportive of the show this past year. They’re good people who want nothing more than to make the best shows for their audience. I know it wasn’t an easy decision for them — they truly do like the show — and I’m grateful for the time and energy they’ve put in to make How To Rock as good as it is. Or was.

There is good news. We made 26 episodes. You’ve only seen 17 of them. Meaning — quick, do the math — there are NINE new episodes still to come and Nick will be showing all of them. Seasons of British shows are often 6 episodes. So if you think British right now, you still have a season and half of new How To Rocks. Smashing.

The next episode that will air is “How To Rock a Singing Telegram” on September 22nd. In it, Gravity 5 raises money for the school by performing singing telegrams in several different musical styles (including one like Big Time Rush, which is awesome). At the heart of the episode is a touching story about friendship. I know you’ll all like it. On September 29th, you’ll see “How To Rock a Yearbook” where Gravity 5 tries to get their own yearbook page, just like the Perfs have. The Perfs, of course, are two steps ahead. You’ll also learn why Zander is so secretive about last year’s yearbook from his old school — and why Stevie and Kevin will stop at nothing to uncover the secret.

There are 3 new episodes in October, including “How To Rock a High School Sensation” with special guest star Romeo Miller and “How To Rock a Camping Trip” in which you’ll be shocked which of the gang takes charge after Zander eats some bad berries. The acoustic campfire version of “Only You Can Be You” will melt you.

Our season — and series — will conclude on December 8th with “How To Rock Christmas.” Tremendous episode. Festive, funny, touching… and Kevin and Nelson are dresses as elves.

My biggest regret about How To Rock not getting a 2nd season is that I won’t be going to work everyday with the truly remarkable people who made the show happen. You know the cast and they are all incredibly talented and gracious people. Cymphonique, Samantha, Halston, Lulu, Max, Chris, Noah, Kirk, Jacob and our many guest stars brought the show to life by truly committing themselves to their characters. (Though I’m not sure Chris and Noah were ever really acting — they are that ridiculous.) I will miss our run-throughs and rehearsals and their pre-show rituals that I was fairly close to figuring out. (“Bunny bunny bunny bunny…”) All of them will continue to shine on screens and stages for years to come and I hope they look back at their How To Rock days with pride.

Behind the cast were a team of writers, producers, directors, production staff and a tireless, phenomenal crew who poured their collective hearts and souls into the show to make sure it looked good, sounded good and felt like a show worthy of being on Nickelodeon or any other channel. We never settled for average, always strived for excellence, and I think we hit far more home runs than we struck out. (Sam and Halston, that is a baseball reference. Can explain it to u more privately.)

Thank you, cast and crew, for your hard work and passion. This past year has been the best professional experience of my life. I hope it was as fun and rewarding for you as it was for me.

And then there are you fans. Wow are you people devoted. Especially you Shippers. As this was my first Nickelodeon show, I have never experienced fandom like I’ve seen on How To Rock. I’ve been overwhelmed (and slightly terrified) by your passion for the show and detailed observations of moments that occurred in various episodes. I am truly sorry that the How To Rock storylines won’t be continuing for multiple seasons because I know you would have been following — and complaining — every step of the way. You have no idea how gratifying it is — Chris and Noah, now would be a good time to google “gratifying” — to have the characters you helped create and develop strike such a chord with so many people. I’ve loved reading your comments about the show on Twitter (even those from the fearsome Zevie Nation) and look forward to seeing what you have to say about the final nine episodes. (Except those from the fearsome Zevie Nation).

I did read some comments about Nickelodeon after the Victorious news came out. I know how difficult it can be when some of your favorite shows go away. And I get the frustration. Try to keep in mind that the people at Nick really are trying to serve their audience the best they possibly can. Be open to the new shows that will be coming on in the next several months. They may surprise you.

Thank you, How To Rock Family, for going on this journey with me. I have loved every minute of it (almost) and could not be more proud of this season. Rather than focusing on what we didn’t get to do, let’s focus on all we’ve done. Life’s too short to worry, don’t you know it’s true. Only you can be you, only I can be me.
